Don't Ignore Brand X Case
In all the hoopla about Grokster being argued before the Supreme Court yesterday, another important case was also on the docket, Brand X, which deals with whether the FCC can treat similar services differently. The case is whether cable internet service is a telecommunications service and subject to common carriage(the FCC says it is not) or whether cable internet service is an "information service" and not subject to common carriage.
